Domingo Co., Ltd. (hereafter "the company") hereby define Privacy Policy (hereafter "this privacy policy) as follows in regards to how we handle private information we collect from users who receive services rendered via this website (hereafter "this service(s), "our service(s)).

 

1. Personal Information

The terms of "personal information" means any information relating to a living individual as defined in the Act on the Protection of Personal Information, including information containing a name, date of birth, address, telephone number, contact details or other identifier or the equivalent made by writing or other means, or information that independently identifies an individual such as data containing appearance, finger print, voiceprint, or health insurance number (Individual identification information).

2. Collection of Personal Information

The company may collect personal information including your name, date of birth, address, telephone number, email address, bank account number, credit card number, driver license number when you register for our services. The company may also collect information containing your personal information such as transaction record and payment record which were provided to its business partners (e.g. information provider, advertiser, advertisement distributor; hereafter affiliate partner(s)) by the user.

3. Purpose of Collecting and Using Your Personal Information

The company collects and uses information about you in order to:

  • Provide and maintain our services

  • Reply to enquiries from you (including confirmation of their identity of them)

  • Send you notices regarding new features of services in use, renewal, campaigns, and other services

  • Notify you of upcoming maintenance, important notices, and other information

  • Identify users who have failed to comply with the terms of service or who has attempted to use our services for a nefarious purpose, and discontinue providing services

  • Support you to review, make changes, delete your account details and to view your usage status.

  • Charge fees for our paid services

  • Accomplish other subsidiary purposes related to the above

4. Changes to the Purpose of Use of Personal Information

The company may make changes to the purpose of use only when the amended purpose is reasonably associated with the previous purpose.

The company notifies users of any changes to the purpose of use of personal information  in a predetermined method and disclose such changes on the website.

5. Disclosure of Personal Information to Third Parties

The company will not disclose your personal information to third parties without your consent for any purposes except in the following cases, unless otherwise permitted by the Act on the Protection of Personal Information or other laws.

  • Cases in which there is a need to protect the life, wellbeing, or property of an individual, and it is difficult to obtain the consent of the identifiable person

  • Cases in which there is a special need to improve public wellbeing or promote healthy child development, and it is difficult to obtain the consent of the identifiable person.

  • Cases in which there is a need to cooperate with a national government organ, local government, or person entrusted thereby with performing the functions prescribed by laws and regulations, and obtaining the consent of the identifiable person is likely to interfere with the performance of those functions

  • Cases the company notifies the person of the following information in advance or makes that information readily accessible to that person in advance, or files a notification of this to the Personal Information Protection Commission

  • The fact that providing the data to the third party constitutes the purpose of use

  • The details of the personal data it will provide to the third party

  • The means or manner in which it will provide the data to the third party

  • The fact that it will cease to provide personal data that can be used to identify the identifiable person to a third party at the request of the identifiable person

  • The means of receiving the identifiable person's request

In the following cases, a person receiving personal data is not to fall under a third party regarding applying the provisions of each preceding paragraph.

  • Where the company entrusts a person with all or part of the handling of personal data within the scope necessary for achieving the purpose of use

  • The personal data is provided when a person succeeds to the business due to a merger or other such circumstances

  • the personal data is provided to specific persons who have joint use of that data, and the business notifies the person identifiable by that data of this in advance as well as the details of that data, the extent of the joint users, the users' purpose of use, and the name and address of the person responsible for managing the personal data, and, if the user is corporation, the name of its representative; or the business makes the foregoing information readily accessible to the person

 

6. Disclosure of Private Information

When having received a request from an identifiable person, the company will disclose personal data the business holds to the person without delay. However, in cases in which disclosing such information falls under any of the following cases, all or a part of the information may not be disclosed. If the company decides not to disclose such information, the company will notify the person of this without delay. A fee of 1,000 yen will be charged for each case of disclosure of personal information.

  • Disclosure is likely to harm the life, wellbeing, property, or other rights or interests of the identifiable person or a third party

  • Disclosure is likely to seriously interfere with the proper implementation of the company

  • Disclosure would violate any other law or regulation

Regardless of the preceding clauses, any information other than personal information including history and characteristic information shall not be disclosed.

 

7. Correction or Deletion of Personal Information

If the content of personal information about you that the company holds is not factual, you may request the company to make a correction, addition, or deletion (hereafter "correction") on the content of the personal information by means predetermined by the company.

When the company has been requested to make a correction pursuant to the provisions of the preceding paragraph and decided to make a correction as requested, the company shall make corrections to the contents of the personal information.

If the company has made a correction to all or part of the contents of the personal information in connection with a request under the preceding paragraph, or has made a decision not to make a correction, the company notifies you of that effect without delay.

 

8. Ceasing to Use or Deleting Personal Information

The company conducts necessary investigation without delay if you request that the company cease to use or delete your personal information (hereafter "ceasing to use or deleting personal information) because the information has been handled in violation of the purpose of use or the information has been obtained by wrongful means.

If the company has determined to accept a request to cease to use or delete personal information  according to the investigation under the preceding paragraph, the company shall conduct ceasing to use or deleting personal information without delay.

If the company has ceased to use or deleted all or part of the contents of the personal information in connection with a request under the preceding paragraph, or has made a decision not to cease to use or delete the personal information, the company notifies you of that effect without delay.

The arrangements in the preceding two paragraphs do not apply if ceasing to use or deleting the personal data would require a costly expenditure or prove otherwise difficult, and the company takes the necessary alternative measures to protect your rights and interests.

 

9. Changes to Privacy Policy

The content of this privacy policy may amended without notice unless otherwise specified by law or in this privacy policy.

Changes to this privacy policy comes into effect when such changes are posted on this website except for cases predetermined by the company.
